Assess the case before escalating it
A strong civil case begins with the documents, the available remedies, and an honest assessment of collectability and cost. A legally valid claim is not always economically sensible to litigate. Likewise, early negotiation is useful only when it protects the client’s position and does not sacrifice essential evidence or deadlines.
Andrew helps clients distinguish immediate preservation work from longer-term strategy and identifies the facts that may create leverage for resolution or trial.
Preserve the record
Contracts, invoices, photographs, messages, inspection reports, personnel records, medical documentation, and contemporaneous notes may all become important. Keep original files and their metadata. Do not edit, annotate, or selectively delete material that could relate to a dispute.
What to bring
- The controlling contract, lease, policy, or agreement
- A chronology of key events
- Important communications and notices
- Records showing claimed losses or payments
- Any lawsuit, subpoena, agency notice, or deadline
Past outcomes do not guarantee future results. Every dispute turns on its own facts, law, evidence, and procedural posture.
